new provisions in Council Period XIII.
Council Streamlined Review of Y2K Contracts (D.C. Code
§ 1-1181.5a(i))
(B13-111 expires June 20, 1999; B13-270 is a congressional
review emergency
passed by the Council on June 8, 1999, with 6-20-99 applicability; and
the temporary
B13-130 is Act 13-66)
- A summary shall be filed with the Chairman containing the name of
contractor, amount of
contract, description of goods and services to be provided,
description of the selection
process, and the background and qualifications of the proposed
contractor.
- Contract is deemed approved when Secretary affixes a time stamp
to the proposed contract
if a summary was filed with the Chairman at least 72 hours prior to
the receipt of the
contract and no resolution of disapproval has been introduced by at
least 9 members of the
Council.
- The 72-hour period excludes Saturdays, Sundays, and Holidays.
- If, within the 72-hour period, a resolution of disapproval has
been introduced and
signed by at least 9 members of the Council, the period of review
is extended by an
additional 7 days.
- Deemed approved on 8th day if the disapproval resolution is not
approved within the
7-day period.
Council Streamlined Review of Contracts in excess of $1
million and Multiyear
Contracts (D.C. Code § 1-1181.5a(j))
(District Charter §
451(b)) (Applies after Bill 13-161 becomes effective or B13-274 becomes
an emergency act)
- A summary shall be filed with the Chairman containing the name of
contractor, amount of
contract, description of goods and services to be provided,
description of the selection
process, the background and qualifications of the proposed
contractor, and other criteria.
- Contract is deemed approved when Secretary affixes a time stamp
to the proposed contract
if a summary was filed with the Chairman at least 96 hours prior to
the receipt of the
contract and no resolution of disapproval has been introduced by at
least 5 members of the
Council.
- The 96-hour period excludes Saturdays, Sundays, and Holidays.
- If, within the 96-hour period, a resolution of disapproval has
been introduced and
signed by at least 5 members of the Council, the period of review
is extended by an
additional 10 days.
- Deemed approved on 11th day if the disapproval resolution is not
approved within the
10-day period.
- Permanent law has a sunset date of December 31, 2000. After
December 31, 2000, if law is
not extended, see chart contained in June 1998 issue of
Legalese for how to count
days for Council review of contracts.
